Residence Requirements and Substantial Ties

Residence Requirements

You can meet the residence requirement if you were present in Australia for at least 2 years in the last 5 years as a permanent visa holder or Australian citizen. That is the basis for the 5-year travel facility.

Substantial Ties

If you do not meet the residence requirement, the department may still grant an RRV where you can demonstrate substantial ties to Australia that are of benefit to Australia. In those cases, the travel facility is generally limited to 12 months.

Compelling and Compassionate Reasons

If you do not meet the residence requirement or substantial ties pathway, subclass 157 may provide a 3-month travel facility in limited circumstances involving compelling and compassionate reasons.

If you have been outside Australia for more than three years, or haven't met the 2-in-5 year rule, you must prove your ties are both substantial and of benefit to Australia.
