Protecting Your Application from Avoidable Risks

Each year, thousands of visa applications fail due to completely avoidable mistakes. The Department of Home Affairs applies the law rigidly. What looks like a minor clerical error to an applicant is often viewed as a breach of regulatory criteria by a delegate, resulting in an immediate adverse outcome.

1. Breaching PIC 4020

Providing false or misleading information—whether intentional or accidental—is the most dangerous mistake you can make. Submitting altered bank statements, fake work references, or failing to declare a past visa cancellation can trigger a 3-year or 10-year non-grant period under Public Interest Criterion 4020.

2. Overclaiming SkillSelect Points

When lodging an Expression of Interest (EOI), the system relies on your honesty. If you claim points for "Superior English" or 5 years of work experience, but your documents only prove "Proficient English" and 4.5 years of experience at the time of your invitation, your visa will not be granted.

3. Missing Critical Windows

Visa processes are tied to strict deadlines that cannot be extended.

  • The 60-Day Rule: Once invited via SkillSelect, you have exactly 60 days to apply.
  • The 28-Day Request: If the Department requests further information (s56 request), you usually have 28 days to provide it. Ignoring these requests or cancelling the application process improperly leads to an automatic adverse outcome.

4. Expired Character and Health Documents

Health checks and Australian Federal Police (AFP) clearances are only valid for 12 months. Furthermore, providing a state-level police check instead of the required Complete Disclosure National Police Certificate from the AFP is a common trap that halts processing.
